filing for child support in SC?
Q: I’m leaving my husband this weekend to go back home and stay with my parents in Columbia SC (we live in summerville Charleston). this is going to start out as the first date to a yrs separation. I’m not telling him anything either, I’m just gonna get up and leave! the only thing that i am concerned about is money situations. i am a house wife and a stay home mom. i don’t have any income of my own. the money i have right now to my name is $6. i just recently learned yesterday that we do not have a joined account with USAA. it is only his name on the main account so he is basically controlling everything! (he is in the air force). so if i leave him, I’ll be leaving broke! he claims that we are pretty much broke at the moment and we would have to wait until next pay day to get other things (he gets paid the 1st and the 15th). i can’t wait that long to leave him because i’m tired of staying here and i feel like i have to constantly walk on eggshells and he is controlling! marriage counseling doesn’t work we have tried that 2 times already and i’m not wasting my time for a third. we have a 2 yr old son together and being that i’m leaving this weekend to stay with my parents i need some money. there should be no excuse as to why we are always broke, we go over bills together (we are only 25 yrs old we don’t have that many bills) and i just don’t see where this extra money is going. he doesn’t put money into my account unless he is deployed and he only give it to me when i ask for it! and it’s still not much. sooo….when i get to columbia this weekend and go to the DSS place on monday morning….what do i need to start out the process of filing child support on him? how much would they give me for my son? do i need:his social security number?my birth certificate or my son’s?a copy of his LES pay stub? (which would be hard to get unless i ask his first sgt for it, if he can give it to me)i just don’t understand how you could be an E-5 in the air force and be broke almost every pay check! i honestly think he married me so he can pay his bills with the extra allowance money…..because my son and i are not getting it! another thing is i have an abscess tooth (not sure how to spell but you get what i mean) and i went to the dentist to get on antibiotics for it. i was supposed to go see an oral surgeon this past tuesday but i had to cancel my appointment because we don’t have enough money for it right now!! are you serious!? i told him that this kind of situation is nothing to play with i could really get sick from this! he doesn’t seem to care! all he cares about is not being broke. but that’s ok because since me and his son is such a burden to him, i might as well leave him! he’s so stupid…a wife and child are basically bills and if your not willing to take that kind of responsibility (whether i work or not) you didn’t need to get married!i really need some advice you guys and i would really appreciate some help thanks 🙂
A: To get any support through the state you’re going to need to file for divorce or a legal separation. The matter of support is up to the courts and without a court order or a voluntary joint agreement the child support enforcement agency cannot help you. However since your husband is in the military you have a few tricks up your sleeve that are not available to the average civilian. The military requires that all members provide adequate support for their dependents. Failure to provide that support can lead to prosecution under the UCMJ along with a lot of other nasty consequences. As soon as you get to your parents’ home, send him a letter demanding that he provide for your support. Send a copy of this letter to his First Sergeant. While the military cannot order a specific dollar amount of support, the barometer we used when I was a First Sergeant was the difference between the With Dependents and Without Dependents rate for Basic Allowance for Housing (BAH). As long as the member was paying at least that much, we could not and would not become further involved absent a court order. That works out to a few hundred dollars per month and may or may not bear any resemblance to what a court might order but is certainly better than nothing. If he does not start paying you anything, keep the heat turned up on on his First Sergeant. Keep the letters brief. Don’t rant. Just advise him that you are not receiving any support from your husband and that you’d appreciate any assistance possible. You’ll probably receive a canned letter in response telling you that while your husband does have an obligation to support his dependents, the military cannot order him to provide any specific level of support absent a court order. Don’t sweat that — it’s standard boiler-plate language. On the back end, every time that you contact the First Sergeant, he will be called in and reminded of his obligation to support his dependents and that if he fails to do so he leaves himself open to sanctions under the UCMJ. Most members get the hint pretty quickly and will come through with the support.(My ex tried that stunt when we separated, claiming that I was not supporting her. I was paying over $1,000 per month in rent and utilities on the house she was living in and the Air Force dropped the case like a hot rock since it was clear that I was providing for her support. I gave my First Shirt copies of the rent receipts as proof and never heard about it again.)As far as medical and dental treatment are concerned, you are eligible for treatment in any military medical facility on a space available basis as long as you are legally married to him. Your child remains eligible until reaching age 19 (or 23 if a full-time student) even after your divorce. You can expedite matters by having your and your child’s medical and dental records forwarded to the nearest military treatment facility. Ft Jackson is in Columbia and Shaw AFB is in Sumter, about 45 miles from Columbia.Once you get a formal court order for support, you can arrange enforcement by sending a copy via certified or registered mail to:Defense Finance and Accounting Service (DFAS)Cleveland Center Garnishment Operations Directorate (DFAS-CL/L)P. O. Box 998002Cleveland, OH 44199-8002Include a cover letter with as much identifying information for your husband as possible, including name, rank, service, SSN, and unit of assignment.Allow at least 60 days for the legal review and service of notice upon the member and the member’s response. DFAS can arrange for payment of the support directly from the member’s military pay if the member does not provide evidence (such as canceled checks or an allotment to you) that they are providing at least as much support as ordered by the court.
My lymph gland is still swollen..?
Q: Back in May I noticed I had a huge lump under my jaw. Was the size of a grape. I went to the dentist and she said I had a fractured wisdom tooth and the fracture was deep. Beside the tooth, I had a huge red ball. Dentist took x-rays and said had infection and maybe a abscess under there. Regardless she gave me some antibiotics and it was still there so went to doctor and my doctor gave me heavy duty antibiotics. Was in terrible pain, with it shooting up to my ear. Wanted to pull the tooth myself. June 11th, went to dentist and had too pulled. How do you spell relief!! Well the lump under my jaw went down to about pea sized. After all this time its still there and I am worried now. How long does it take and can it take this long to go down? I went for a teeth cleaning last month and the hygienist did a complete check of mouth, throat and tongue, glands. She didn’t seem concerned it was still there. I am worried can it take this long to go down? It has not grown, still size of a pea approx.
A: You don’t say how long “this long” is, but it’s normal for lymph nodes to become swollen when you have infection. Are you worried the infection is going to flare up again? That isn’t going to happen. Since you posted this in the cancer section are you worried that you had cancer instead of an infected tooth? That is doubtful as pulling the tooth would not have eliminated it and you would not have healed.
